Lillooet Camelsfoot Television and Radio Rebroadcasting Contribution Service Conversion and Establishment Bylaw

Summary

A Request for Decision was considered at the SLRD Board meeting, May 25, 2022 recommending the removal of Pavilion Lake from the Lillooet Camelsfoot Television and Radio Rebroadcasting Contribution Service Establishment area. The Board passed first three readings of the bylaw and it has been submitted to the Ministry of Municipal Affairs with a request for approval from the Inspector of Municipalities.

Background

The Lillooet Camelsfoot Television and Radio Rebroadcasting Contribution Service Conversion and Establishment Bylaw No. 1214-2011 established the Lillooet Camelsfoot Television and Radio Rebroadcasting contribution service to provide a contribution to the Lillooet Camelsfoot TV and Radio Association (the “LCTVRA”) within the area defined by the Bylaw, being the District of Lillooet and a portion of electoral area B (the “Current Service Area”).

There have been two prior amendments to the Bylaw regarding taxation apportionment. The Pavilion Lake Residents and Property Owners Association (the “PLRPOA”) have advised the SLRD that they are not receiving adequate service as a result of mountains obstructing the signal and would like the boundaries of the service area redrawn to permit removal of the affected properties.

During 2021 SLRD staff conducted two assessments of radio signal strength and determined that service in the vicinity of Pavilion Lake is inconsistent in some places and absent in others. Subsequently, conversations were held with both the PLRPOA and the LCTVRA and it was agreed that the service at Pavilion Lake is not the same as the rest of the Current Service Area and redrawing the service area boundaries would be appropriate.

In discussions with the Area B Director, it was indicated to be better use of financial resources and staff time if the SLRD forgoes the formal service review and instead amend the boundaries to the Current Service Area to remove the Pavilion Lake area. PLRPOA has vigorously supported their removal from the service area and LCTVRA has consented to the boundary adjustment.

There are 65 folios within the Current Service Area that are proposed to be removed in the bylaw amendment as well as unsurveyed Crown lands. The unsurveyed Crown Lands are not counted within the total folios for the service nor do they contribute to the tax base via tax requisitions.

The amendment to the service establishment Bylaw is authorized by section 350(1) of the Local Government Act and is intended to align the area throughout which the service is provided, and from which the full cost of the service is recovered. It has been confirmed by LCTVRA that they are not in a position to improve the service in order to provide the same level of radio transmission to Pavilion Lake as the rest of the Current Service Area due to resource constraints

There would be no impact to services within the Current Service Area. Taxation is anticipated to increase slightly per property and remain within existing maximum requisition limits.

The proposed Reduced Service Area would remove the parcels that are not benefitting from the service and they would no longer pay taxes for the service.

A service establishment bylaw amendment must be completed in accordance with the requirements applicable to the adoption of the original service establishment bylaw (i.e. elector assent or petition) or with the consent of the participating areas via the written consent of the participating areas (the District of Lillooet and Electoral Area B Director). The approval of the Inspector of Municipalities is also a requirement. While a number of letters have been received from PLRPOA requesting the adjustment to remove the non-benefitting properties, no formal petition has been received.
