Lillooet Lake Estates Service Establishment and Loan Authorization Bylaws

The SLRD Board, at its December 14, 2022 meeting, adopted Bylaw No. 1786-2022 (Squamish-Lillooet Regional District Catiline Creek Debris Flow Mitigation Service Establishing Bylaw No. 1786-2022) and 1787-2022 (Squamish-Lillooet Regional District Catiline Creek Debris Flow Mitigation Service Loan Authorization Bylaw 1787-2022).


Summary

A Request for Decision (RFD) was considered at the SLRD Board meeting, September 28, 2022 in regard to a petition from the community of the Lillooet Lake Estates for a service establishing bylaw and loan authorization for the Catiline Creek debris flow mitigation. At the Board meeting, first three readings were given to both the service establishing bylaw and the service loan authorization bylaw.

Upon obtaining the written consent of the Electoral Area C Director, submission was  made to the Ministry of Municipal Affairs for Inspector Approval.

Background

Construction of a debris flow mitigation structure along Catiline Creek at the community of Lillooet Lake Estates (LLE) has been a priority for the community for several years, subsequent to major debris flow events occurring, most recently in 2010 and 2013.

Numerous provincial and federal grants have been applied for by the SLRD and by LLE over the past years, none of which have been approved to date.

A service establishment bylaw and loan authorization bylaw require confirmation of maximum funding requisitions in order to proceed and cannot rely upon speculative funding sources. With confirmation of support from the property owner and LLE site owners for both full and phased project options, it has now been demonstrated that the project has the support of the local community to proceed with the loan authorization as core funding has been approved, and grant funding can be applied for as opportunities arise in order to minimize the financial impact to the community (should the grant funding applications be successful).

The petition requests the establishment of a new local debris flow mitigation service at Catiline Creek and borrowing to a maximum of $4 million, whereby the property owner of LLE is requisitioned via parcel tax at a rate that will recover the proposed costs of service establishment and loan authorization, including designing, constructing, operating and maintaining a debris flow mitigation structure for Catiline Creek.

The Local Government Act requires at section 348, that if a Board proposes to borrow money for the start of a service, the establishing bylaw and the loan authorization bylaw must, for the purposes of obtaining participating area approval, be dealt with as if they were one bylaw. The corporate and site owner petitions both therefore include a request for both the service establishment and loan authorization for the debris flow mitigation structure for Catiline Creek.
